Mediation. Basic Skill. Training for Tomorrow’s Lawyers

In European countries, 80% of litigation and mediation cases settle without litigation. In the United States, mediation is an absolute attribute of the legal system. In Ukraine, mediation is gradually becoming a more prominent and necessary tool in the practice of law.

Mediation is often the only effective way to resolve disputes. It is the involvement of mediators, which can help resolve a dispute quickly and satisfy the interests of both parties. It is important that, unlike formal litigation, the parties reach an agreement independently during mediation.

On June 6-7, 2019, the “Tomorrow’s Lawyer” Program, with the support of the US Embassy in Ukraine, conducted a two-day inter-module training for 24 lawyers from third hundred on “Mediation. Basic skills. The role of a lawyer in mediation”. The training conducted experienced mediators and trainers Roman Koval and Alyona Gorova. The participants of the training were selected by a special commission based on their answers in questionnaires.

The training covered basic aspects of mediation process:

  • approaches to conflict resolution;
  • the role of the lawyer in mediation;
  • the difference between positions and interests in the mediation process;
  • mediation bias strategy;
  • principles of mediation and ethics of the mediator.

“Tomorrow’s Lawyer” is a powerful network of lawyers uniting opinion leaders in the legal profession, who provide legal assistance in accordance with the highest ethical standards, act as agents of change in society and leaders in the professional community.

The “Tomorrow’s Lawyer” Program was launched in 2016 and first implemented within the “Quality and Accessible Legal Aid” Project, carried out by the Canadian Bureau for International Education with the support of the Government of Canada in cooperation with the Legal Aid Coordination Centre. It is currently being implemented and developed with the support of the US Embassy’s Law Enforcement Section in Ukraine, the “Tomorrow’s Lawyer” NGO, in partnership with the Ukrainian Bar Association and the Bar Association of Legal Aid Providers.
